Providence's zoning landscape is more layered than most Rhode Island communities — the city administers a detailed zoning ordinance across multiple residential districts (R-1, R-2, R-3, RA, RB, and others) with varying dimensional requirements. Rhode Island's 2024 ADU legislation creates a baseline right that applies city-wide, but the specific district your property falls in determines setbacks, lot coverage limits, and the feasibility of different ADU types.
Rhode Island General Laws §45-24-73 (amended June 2024) establishes by-right ADU eligibility statewide. Under this law, one ADU per lot is permitted by right where: (1) the lot is 20,000 square feet or more and the primary use is residential; (2) the ADU fits within the existing footprint of the primary structure or an existing accessory structure without expanding that footprint; or (3) the ADU is a reasonable accommodation for a family member with a disability. State law sets maximum ADU sizes at 900 sq ft (or 60% of the principal dwelling's floor area, whichever is less) for a studio or one-bedroom unit, and 1,200 sq ft for a two-bedroom unit subject to the same 60% cap. Rhode Island's ADU legislation prohibits all ADUs from being used as short-term rentals — they must serve long-term tenancy or household members.
Providence uses its own online zoning portal (Providence RI Online Property Information, accessible through the city website) to look up your parcel's district. Permits are processed through the Providence Building Department and Inspection Services Division at 444 Westminster Street. Providence's zoning code was updated in 2024–2025 to align with state ADU law, and qualifying ADU applications are reviewed administratively — no special use permit or variance required for by-right projects.
Key dimensional rules vary by district — in R-1 and R-2 zones, minimum lot sizes are generally 6,000–8,000 sq ft, while larger districts require more. Side and rear setbacks for accessory structures typically range from 5 to 15 feet depending on the specific district. For interior ADUs that fit within the existing building footprint, most of these dimensional requirements do not apply — making within-footprint conversions the most straightforward ADU path in Providence's denser urban zones.
