Under Rhode Island General Laws §45-24-73 (amended June 2024), Warwick homeowners have a right to build one ADU per lot under any of these conditions:
Warwick's residential zones — R-40, R-15, R-10, and R-6 — each carry different minimum lot sizes, setbacks, and height limits. The R-40 district requires front setbacks of 35 feet and side setbacks of 15 feet, which affects where a detached structure can sit on the lot. All residential zones cap building height at 35 feet. Maximum ADU size under state law is 900 sq ft for a one-bedroom unit and 1,200 sq ft for a two-bedroom unit (or 60% of the principal dwelling's floor area, whichever is less).
